Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the platform operated by LetMeCall LLC (“LetMeCall,” “we,” “our,” or “us”), including our website, APIs, and all related services (collectively, the “Service”). By creating an account or using the Service, you agree to be bound by these Terms.
If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms, and “you” refers to that business.
If you do not agree to these Terms, do not use the Service.
Description of Services
LetMeCall provides an AI-powered voice and messaging automation platform designed for home service businesses. The Service enables businesses to:
- Deploy AI agents to handle inbound and outbound phone calls
- Send transactional SMS messages — such as appointment confirmations and photo-upload links — to their clients
- Manage leads, appointments, and call analytics through a web dashboard
- Integrate with third-party CRM and scheduling tools
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.
Accounts & Registration
To use LetMeCall, you must create an account and provide accurate, complete information including your legal business name, email address, and billing details. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must notify us immediately at vkim@letmecall.ai if you suspect unauthorized access to your account.
You may not share account credentials with third parties or create accounts for the purpose of circumventing usage limits or policies.
Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:
- Use the Service to send unsolicited communications (spam) or contact individuals who have not consented to receive messages from you
- Impersonate any person, business, or entity, or misrepresent your identity or affiliation
- Use the Service for any illegal purpose, including violations of telemarketing laws (TCPA, FCC regulations), consumer protection laws, or data privacy laws
- Attempt to bypass, disable, or interfere with security features of the Service
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Resell or sublicense access to the Service without prior written consent
- Use the Service to conduct or promote any fraudulent activity
- Send calls or messages to numbers on the National Do Not Call Registry without a proper legal exemption
SMS & Calling Rules
The Service facilitates outbound phone calls and SMS messages on your behalf. As a user of these features, you are the sender of record and bear full legal responsibility for compliance with all applicable laws, including the Telephone Consumer Protection Act (TCPA), FCC regulations, and CTIA guidelines.
Consent Requirement
You must obtain appropriate prior consent from any individual before sending them automated calls or SMS messages through the Service. You represent and warrant that all phone numbers you submit to the Service belong to individuals who have consented to receive communications from your business.
Opt-Out Compliance
You must honor all opt-out requests promptly. Recipients may reply STOP to any SMS to unsubscribe. You may not contact an individual who has opted out, and you must configure your account to suppress opted-out numbers.
Carrier Registration & Verification
US carriers require sender registration before automated SMS can be delivered. Depending on the number type you use, this means either toll-free verification (for toll-free numbers) or A2P 10DLC (Application-to-Person) registration (for standard 10-digit long codes). LetMeCall will require you to complete the applicable registration or verification before enabling SMS features. You agree to provide accurate, complete, and current business information, opt-in details, and sample messages for this process. Providing false information will result in account termination.
Permitted Message Types
SMS features may only be used for transactional messages directly tied to a caller’s request — such as appointment confirmations, photo-upload links, and related service notifications. Marketing campaigns, bulk promotional blasts, or political messaging are not permitted.
Platform Notifications to You
Separately from the messages you send to your clients, LetMeCall may send operational SMS notifications to the mobile number you provide in your account settings — such as alerts about new bookings, missed calls, appointment reminders, photo uploads, and SMS registration status. You opt in to these by enabling the SMS channel in your settings, and you may opt out at any time by disabling it or by replying STOP. These are transactional service messages related to your use of the platform, not marketing.
Billing & Payments
Access to LetMeCall requires a paid subscription. By subscribing, you authorize us to charge your payment method on a recurring basis at the rates shown at the time of purchase.
All fees are in US dollars and are non-refundable except as required by law or as explicitly stated in our refund policy. We reserve the right to change pricing with 30 days’ notice.
If payment fails, we may suspend your account until payment is resolved. You are responsible for any taxes applicable to your use of the Service.
Usage-based charges (such as per-minute call costs and per-message SMS costs) are billed in arrears and added to your monthly invoice. You can view usage estimates in your dashboard at any time.
Data & Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described therein.
You retain ownership of all data you submit to the Service, including client contact information and call recordings. You grant LetMeCall a limited license to process this data solely to provide the Service to you.
You are responsible for ensuring that your collection and submission of client data to the Service complies with applicable privacy laws, including CCPA and any other relevant regulations.
Intellectual Property
The Service, including all software, AI models, designs, logos, and content created by LetMeCall, is owned by LetMeCall and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property beyond the limited right to use the Service as described herein.
You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.
Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. AI-generated call transcripts and summaries may contain errors and should not be relied upon as the sole record of a conversation.
LetMeCall is not responsible for the content of calls or messages sent by your AI agent. You are responsible for configuring your agent appropriately and reviewing its outputs.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LETMECALL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.
Termination
You may cancel your account at any time through your account settings. Cancellation takes effect at the end of your current billing period.
We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or fail to pay amounts owed. We may also terminate accounts for any reason with 30 days’ notice.
Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after termination, after which it will be permanently deleted unless legally required to keep it longer.
Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Sacramento County, California, and you consent to personal jurisdiction in those courts.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email or through a notice in the platform at least 14 days before the changes take effect.
Continued use of the Service after the effective date of any update constitutes your acceptance of the revised Terms.
